Below you will find the privacy statement of Moxy BV.
We will only use your personal data in accordance with the Privacy Act and other relevant legal regulations in force. Every reference in this Privacy Statement to the Privacy Act means a reference to the Act of 8 December 1992 on the protection of privacy with regard to the processing of personal data. Any reference to the Regulation is a reference to the Regulation of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data.
Moxy respects the privacy of all users of its site and ensures that the personal information you provide is treated confidentially.
When you send e-mail or other messages to us, it is possible that we keep those messages. Sometimes we will ask you for your personal details that are relevant to the situation in question. This makes it possible to process your questions and answer your requests.
All personal information provided is stored on Moxy’s own secure servers or those of a third party. We will not combine this information with any other personal information we may have.

2. Personal data that we collect
Moxy undertakes to process only those data that are relevant and necessary for the purposes for which they were collected. The following categories of personal data may be processed by Moxy:
2.1. Personal data is any data relating to an identified or identifiable natural person. Identifiable refers to identification data (such as name, ID number, location data, etc.) that can be used to identify you directly or indirectly (as a natural person).
2.2. We will include your data, such as name, address and telephone number, e-mail address in a database/database. The processing of your data is recorded in our processing registers under the GDPR regulation by Moxy.
(a) Your data will be used for the performance of contracts concluded with you. In addition, we may use your data to keep you informed of interesting information, tips and advice, and/or offers. Your details will not be sold or passed on to a third party.
You can be an existing or former customer or supplier of us. In such a case we will use your personal information to communicate with you about (the status of) our services or your services. We may also use your personal information for the purposes set out in (b) or (c).
(b) You may be interested in our services as a communications agency. Therefore, we use your personal information for direct marketing purposes to send you messages and newsletters about our services and our business, and planned events.
(c) You may be interested in working for or with us. Therefore, we use your personal data for direct marketing or to communicate with you about opportunities and to request offers.
(d) You may use our website’s contact form to ask a specific question about our services or our website, or about the opportunities we offer you to work with us. You may also use our website to subscribe to our newsletter. In that case, we will use your personal information to respond to your request and we may use your personal information for (b) or (c).
(e) We collect and process your personal data to support our website and to improve your user experience. This includes ensuring the security, availability, performance, capacity and condition of the website.
(f) We may use your personal data to exercise or enforce the rights we have under applicable law, such as to record, exercise or defend legal claims. We may also use your personal data to fulfil our obligations as set out in applicable law.
The information you provide will be used to process your requests, either by ourselves or by others involved in processing them.

By Moxy and certain organisations: for marketing purposes, if you have given your consent.

2.3. You may unsubscribe from messages as set out in Objective 2.2 at any time. (b) or 2.2. (c) (for direct marketing) using the procedure set out in our communications.
2.4. The following categories for personal data can be distinguished:

We may receive your personal information directly from you when (i) you request information to view the opportunities to use our services other than through the contact form, (ii) you use our services, (iii) we ask you for information about the opportunities to use your services or, (iv) we use your services. In such cases, we will receive and process the following personal information: your name, telephone number, email address, address and other personal information that we have requested. These personal data will be processed for the purposes set out in clause 2.2(a), 2.2(b) and/or 2.2(c). We must process such personal data in order to comply with our obligations as they apply to our potential or actual working relationship and/or contractual connection.

If you (i) use the contact form on our website to contact us about our company and services or (ii) subscribe to our newsletter, we collect personal information: (i) your name, telephone number, email address and any personal information you provide in the message box (do not use this box to share bank account details, credit card details or sensitive information, such as health information with us), or (ii) your email address. These are personal data provided directly by you to us and used for the purposes set out in clause 2.2.(b), 2.2.(c) and/or 2.2.(d). The legal basis for processing such personal data is your consent.
If you provide us with a business card during an event or meeting, we may process your personal data: your name, telephone number, e-mail address, address and any other personal data mentioned on your business card. In this case, your personal data will be processed for the purposes set out in article 2.2.(b) and/or 2.2.(c). The legal basis for such processing is our legitimate interest in promoting your interest in us and our business relationship by keeping you informed of relevant information about our services and our company.
2.5. We may also use your personal data for the purposes set out in 2.2.(f), as may be necessary to comply with a legal obligation or our legitimate interest.
3. Purpose and legal basis
Moxy uses the information we collect to run our business and to bring to your attention the products we offer, including the use of data to improve our products and to personalise your experience. We collect your personal data for a variety of purposes, such as processing your order, carrying out correspondence with you, providing you with a subscription, or processing a job application.
Data processing is essential for the operation of the platform/website/application and the associated services. Processing takes place exclusively for the following well-defined purposes:
Offering and improving a general and personalised service; including billing purposes, offering information, newsletters and offers that are useful and/or necessary to you, obtaining and processing user reviews and providing support.
Offering and improving the delivered products; personalized and specific products on the basis of information and data provided.
The detection of and protection against fraud, errors and/or criminal behaviour.
Your data, together with information about you, can be analysed in order to tailor the information and/or offers as much as possible to your interests. We can send you this information and/or offers by e-mail or by post/ courier. This is in order to tailor our services as much as possible to our (potential) customers.
In addition, we may also collect information relating to your use of our websites. For this we use various techniques, including cookies.
During a visit to the platform/website/application of Moxy, some data is collected for statistical purposes via cookies. Such data is necessary to optimise the use of our platform/website/application. This data is: IP address, probable place of consultation, hour and day of consultation, which pages were visited. When you visit the Moxy platform/website/application, you agree to this data collection for static purposes as described above.
Personal data is only processed for internal use within Moxy.
We can therefore assure you that personal data will not be sold, passed on or communicated to third parties associated with us. Moxy has taken all possible legal and technical precautions to avoid unauthorised access and use.
4. Storage period and disposal
- We will retain your information for as long as your account is active or to the extent necessary to provide you with services. If you would like us to stop using your registration information to provide you with services, please contact us. After termination of the contract the data will be stored for 5 years on a local and secure server at Moxy.We will retain and use your registration information to the extent necessary to comply with our legal obligations, to resolve disputes and to enforce our agreements.
4.1. Your personal data will not be kept longer than necessary for any specific purpose. However, as it is not possible for us to specify such a period in advance, the retention period will be determined as follows:
(a) Personal data used by us for the provision of services to you or your services to us, as set out in clause 2.2. (a) will be stored, retained and used for as long as necessary to provide the services and will be stored and used for direct marketing.
(b) Personal data used by us for direct marketing as set out in clause 2.2. (b) or 2.2. (c) will be stored, retained and used for as long as we believe you will benefit from our communications.
(c) Personal information provided to us via the contact form will be stored, retained and used for as long as necessary to respond to your request and will be stored and used for direct marketing.
(d) Usage data will be stored and retained for as long as such data is useful for the support of the website.
4.2. Should you withdraw your consent or object to our use of your personal data and such objection is justified, we will delete your personal data from our databases. Please note that we retain personal data to ensure that your preferences are respected in the future and only to ensure that you do not receive any further communications from us.
4.3. The foregoing, however, will not prevent us from retaining information and content for lawful purposes such as, but not limited to, the exercise or defence of any legal claim, evidentiary purposes, back-up, administration and the performance of other legal rights and obligations that we may have.

7. Rights of the person concerned
You can retrieve your own data and request that they be corrected or deleted. For all other rights provided for in the GDPR Regulation, you can obtain the necessary information. For this purpose, you can easily send an e-mail with your question to [email protected]
7.1. This article sets out your main rights under the Data Protection Act. We have tried to summarise them in a clear and legible way.
7.3. The right of access
7.4. You have the right to receive from us a copy of any personal data held by us, provided that this does not adversely affect the rights and freedoms of others. The first copy will be provided free of charge but we reserve the right to charge a reasonable fee should you request further copies.
7.5. Right of rectification
If the personal data in our possession are inaccurate or incomplete, you have the right to rectify or supplement this information, taking into account the purposes of processing.
7.6. The right to have data erased (the right to be forgotten)
In certain circumstances, you have the right to delete your personal data without undue delay. These are the following circumstances:
(a) The personal data are no longer necessary for the purposes for which they were collected or otherwise processed;
(b) You withdraw your consent and there is no other legal basis;
(c) The processing is for the purpose of direct marketing;
(d) The personal data has been unlawfully processed; or
(e) The erasure of data is necessary to comply with EU or Belgian legislation.
7.7. There are certain exceptions to the right of data erasure. These exceptions include those cases where processing is necessary
(a) for the exercise of the right to freedom of expression and freedom of information;
(b) to comply with a legal obligation; or
(c) for recording, exercising or defending legal claims.
7. 8. The right to restrict data processing
You have the right to restrict the processing of your personal data (this means that the personal data may only be stored by us and used for limited purposes), if:
(a) you dispute the accuracy of data (and only for as long as it takes to verify accuracy);
(b) the processing is unlawful and you request limitation (as opposed to exercising the right to erase data);
(c) we no longer need the personal data for the processing, but you require personal data for the purpose of recording, exercising or defending legal claims; or
(d) you have objected to the processing, pending verification of that objection.
7.9. In addition to our right to store your personal data, we may still process it by other means, but only:
(a) with your consent;
(b) for recording, exercising or defending legal claims;
(c) to protect the rights of any other natural or legal person; or
(d) for reasons of substantial public interest.

7.11. The right to data portability
If your consent is the legal basis for the processing of your personal data and such processing is carried out automatically, you have the right to receive your personal data from us in a structured, commonly used and machine-readable format. However, this right does not apply where this would adversely affect the rights and freedoms of others.
7.12. You also have the right to have your personal data transferred directly to another company, if this is technically possible, and/or to store your personal data on your own device for further personal use.
7.13. The right to object to processing
You have the right to object to the processing of your personal data on the basis of your specific situation, but only to the extent that the legal basis for processing is that the processing is necessary for the purpose:
(a) the performance of a task carried out in the public interest or in the exercise of official authority vested in us;
(b) legitimate interests pursued by us or a third party.
7.14. If you object, we will cease processing personal data unless we can demonstrate that there are compelling legitimate grounds for processing which override your interests, rights and freedoms or that the processing is intended to record, exercise or defend legal claims.
7.15. You have the right to object to the processing of your personal data for the purpose of direct marketing (including profiling for the purpose of direct marketing). If you object, we will stop processing your data for this purpose.
7.16. The right to lodge a complaint with a supervisory authority
If you believe that the way in which we process your data infringes data protection law, you have a legal right to lodge a complaint with a supervisory authority responsible for data protection. You can do this in the EU Member State of your habitual residence, your place of work or the location where the alleged breach took place. 8. International data transfer
8.1. We will ensure that a transfer of data to countries outside the European Economic Area is carried out with appropriate security measures. As we use Google Services, your personal data may be transferred outside the European Economic Area.
8.3. You hereby authorise us to transfer your personal data outside the European Economic Area.
9. The disclosure of your personal data to others
9.1. In order to provide you with our services and to maintain a database containing your contact details, we work with a third party service provider to process and store your personal data. We work with the following service providers:
(a) databases/hosting: Yadera
(b) cloud platform: Google Inc.
(c) website host: Combell
9.2. If you are a customer of ours, we may disclose your personal data to the suppliers we have contracted or intend to contract in order to provide our services to you. If you are a supplier to us, we may disclose your personal information to our customers to introduce you as a potential supplier, or in the course of providing the services.
9.3. We may also disclose your personal data in the event that this is necessary to comply with a legal obligation. We may also disclose personal information to protect your vital interests or the vital interests of another natural person.
9.4. As such, we do not disclose personal data to our social media partners. However, we do use social media plug-ins to direct you to our social media channels and give you the opportunity to use our content. These social media channels are Facebook, Instagram, LinkedIn, Twitter, Google+, Vimeo, Youtube and Pinterest. When you share an item via Twitter, LinkedIn or Google+, like an item using ‘Like’ on Facebook, watch a video embedded in our website via Vimeo, or click on a link to our profile on a social media channel, such a social media service provider may collect personal information about you and link that information to your existing profile on such channel. In such event, the social media service provider will act as an administrator.
9.5. We are not responsible for the use of your personal information by any such social media service provider. Please take a moment to familiarise yourself with the privacy policies of the aforementioned companies. 10. Security and accuracy of information
We want to protect your personal data and maintain its accuracy. Moxy reasonably implements physical, administrative and technical security measures to protect your personal information from unauthorized access, use and disclosure. For example, we encrypt certain sensitive personal information when we send it over the Internet. We also require our suppliers to protect such data from unauthorized access, use and disclosure.
