We/we’ and ‘us’ refer to Moxy ; We are the custodian of the personal data that we collect, as set out in this privacy policy. Our website, https://Moxy.be , is owned and operated by us.

At Moxy, we are aware that you place your trust in us and our services. We therefore see it as our responsibility to protect your privacy. In our privacy policy we would like to inform you about what information we collect from you when you use our website, the purpose for which we collect it and how we can improve your user experience. This will give you a transparent view of how we work.

We will only use your personal data in accordance with the Privacy Act and other relevant legal regulations in force. Every reference in this Privacy Statement to the Privacy Act means a reference to the Act of 8 December 1992 on the protection of privacy with regard to the processing of personal data. Any reference to the Regulation is a reference to the Regulation of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data.

This privacy policy applies to Moxy’s services. You should be aware that Moxy is not responsible for the privacy policies of other sites and resources. By using our platform/our website/our application, you expressly consent to any processing by Moxy.

Moxy respects the privacy of all users of its site and ensures that the personal information you provide is treated confidentially.

2. Personal data that we collect

Moxy undertakes to process only those data that are relevant and necessary for the purposes for which they were collected. The following categories of personal data may be processed by Moxy:

2.1. Personal data is any data relating to an identified or identifiable natural person. Identifiable refers to identification data (such as name, ID number, location data, etc.) that can be used to identify you directly or indirectly (as a natural person).

2.2. We will include your data, such as name, address and telephone number, e-mail address in a database/database. The processing of your data is recorded in our processing registers under the GDPR regulation by Moxy.

(a) Your data will be used for the performance of contracts concluded with you. In addition, we may use your data to keep you informed of interesting information, tips and advice, and/or offers. Your details will not be sold or passed on to a third party.

2.3. You may unsubscribe from messages as set out in Objective 2.2 at any time. (b) or 2.2. (c) (for direct marketing) using the procedure set out in our communications.

2.4. The following categories for personal data can be distinguished:

Contact details (provided directly by you):

We may receive your personal information directly from you when (i) you request information to view the opportunities to use our services other than through the contact form, (ii) you use our services, (iii) we ask you for information about the opportunities to use your services or, (iv) we use your services. In such cases, we will receive and process the following personal information: your name, telephone number, email address, address and other personal information that we have requested. These personal data will be processed for the purposes set out in clause 2.2(a), 2.2(b) and/or 2.2(c). We must process such personal data in order to comply with our obligations as they apply to our potential or actual working relationship and/or contractual connection.

 

Contact details (provided by a third party):

We may receive your personal information (i) via a third party we have contracted to obtain your personal information or (ii) via Google statistics/reports. In such cases we will receive and process the following personal data: your name, telephone number, email address, address and other personal data we have requested. These personal data are processed for the purposes set out in article 2.2.(b) and/or 2.2.(c). Before we use (other than for storage) personal data that we have not received directly from you, we will provide you with this privacy policy as soon as possible and ask your consent to the use of your personal data.

Data in information requests:

If you (i) use the contact form on our website to contact us about our company and services or (ii) subscribe to our newsletter, we collect personal information: (i) your name, telephone number, email address and any personal information you provide in the message box (do not use this box to share bank account details, credit card details or sensitive information, such as health information with us), or (ii) your email address. These are personal data provided directly by you to us and used for the purposes set out in clause 2.2.(b), 2.2.(c) and/or 2.2.(d). The legal basis for processing such personal data is your consent.

 

Business cards:

If you provide us with a business card during an event or meeting, we may process your personal data: your name, telephone number, e-mail address, address and any other personal data mentioned on your business card. In this case, your personal data will be processed for the purposes set out in article 2.2.(b) and/or 2.2.(c). The legal basis for such processing is our legitimate interest in promoting your interest in us and our business relationship by keeping you informed of relevant information about our services and our company.

Usage Data:

We may collect personal data about your activities on our website: IP address, device ID and type, referral source, language settings, browser type, operating system, geographic location, length of visit, page views, or information about the timing, frequency and pattern of your use of our services. This information may be collected and used to help us provide useful information about the use of our website. If the usage data is completely anonymous (and therefore cannot be traced back to you as a person), it will not be considered as personal data for the purpose of this privacy policy. These are personal data which we may record through the use of your device and which are used for the purposes set out in clause 2(e). The legal basis for collecting such personal data is our legitimate interest in monitoring and improving our website and remembering your preferences in order to provide you with a better user experience. 2.5. We may also use your personal data for the purposes set out in 2.2.(f), as may be necessary to comply with a legal obligation or our legitimate interest.

2.6. Should the legal basis for processing such personal data be your consent, you will have the right to withdraw your consent at any time. However, this does not affect the lawfulness of data processing carried out prior to the withdrawal of your consent. Should the legal basis for the processing of data be our legitimate interest, you have the right to object to such processing as set out in article 4.12 of this privacy policy.

3. Purpose and legal basis

Moxy uses the information we collect to run our business and to bring to your attention the products we offer, including the use of data to improve our products and to personalise your experience. We collect your personal data for a variety of purposes, such as processing your order, carrying out correspondence with you, providing you with a subscription, or processing a job application.

Data processing is essential for the operation of the platform/website/application and the associated services. Processing takes place exclusively for the following well-defined purposes:

Offering and improving a general and personalised service; including billing purposes, offering information, newsletters and offers that are useful and/or necessary to you, obtaining and processing user reviews and providing support.
Offering and improving the delivered products; personalized and specific products on the basis of information and data provided.

Such data is necessary to optimise the use of our platform/website/application. This data is: IP address, probable place of consultation, hour and day of consultation, which pages were visited. Personal data is only processed for internal use within Moxy.
We can therefore assure you that personal data will not be sold, passed on or communicated to third parties associated with us. Moxy has taken all possible legal and technical precautions to avoid unauthorised access and use.

 

4. Storage period and disposal

  • We will retain your information for as long as your account is active or to the extent necessary to provide you with services. If you would like us to stop using your registration information to provide you with services, please contact us. After termination of the contract the data will be stored for 5 years on a local and secure server at Moxy.We will retain and use your registration information to the extent necessary to comply with our legal obligations, to resolve disputes and to enforce our agreements.

    4.1. Your personal data will not be kept longer than necessary for any specific purpose. However, as it is not possible for us to specify such a period in advance, the retention period will be determined as follows:

    (a) Personal data used by us for the provision of services to you or your services to us, as set out in clause 2.2. (a) will be stored, retained and used for as long as necessary to provide the services and will be stored and used for direct marketing.

    (b) Personal data used by us for direct marketing as set out in clause 2.2. (b) or 2.2. (c) will be stored, retained and used for as long as we believe you will benefit from our communications.

    (c) Personal information provided to us via the contact form will be stored, retained and used for as long as necessary to respond to your request and will be stored and used for direct marketing.

    (d) Usage data will be stored and retained for as long as such data is useful for the support of the website.

    4.2. Should you withdraw your consent or object to our use of your personal data and such objection is justified, we will delete your personal data from our databases. Please note that we retain personal data to ensure that your preferences are respected in the future and only to ensure that you do not receive any further communications from us.

    4.3. The foregoing, however, will not prevent us from retaining information and content for lawful purposes such as, but not limited to, the exercise or defence of any legal claim, evidentiary purposes, back-up, administration and the performance of other legal rights and obligations that we may have.

7. Rights of the person concerned

You can retrieve your own data and request that they be corrected or deleted. For all other rights provided for in the GDPR Regulation, you can obtain the necessary information. For this purpose, you can easily send an e-mail with your question to gdpr@Moxy.be.

7.1. This article sets out your main rights under the Data Protection Act. We have tried to summarise them in a clear and legible way.

7.2. If you wish to exercise your rights, please send us a written request in accordance with Article 1 of this privacy policy. We will respond to your request without undue delay, but in any event within one month of receipt of the request. Should an extension of the deadline for responding to your request be necessary or should we fail to act on your request, we will inform you accordingly.

7.3. The right of access

You have the right to receive confirmation from us as to whether or not we are processing your personal data. Should this be the case, you have the right to access such personal data, together with any additional information also set out in this privacy policy.

7.4. You have the right to receive from us a copy of any personal data held by us, provided that this does not adversely affect the rights and freedoms of others. The first copy will be provided free of charge but we reserve the right to charge a reasonable fee should you request further copies.

7.5. Right of rectification

If the personal data in our possession are inaccurate or incomplete, you have the right to rectify or supplement this information, taking into account the purposes of processing.

7.6. The right to have data erased (the right to be forgotten)

In certain circumstances, you have the right to delete your personal data without undue delay. These are the following circumstances:

(a) The personal data are no longer necessary for the purposes for which they were collected or otherwise processed;

(b) You withdraw your consent and there is no other legal basis;

(c) The processing is for the purpose of direct marketing;

7.12. You also have the right to have your personal data transferred directly to another company, if this is technically possible, and/or to store your personal data on your own device for further personal use.

7.13. The right to object to processing

You have the right to object to the processing of your personal data on the basis of your specific situation, but only to the extent that the legal basis for processing is that the processing is necessary for the purpose:

(a) the performance of a task carried out in the public interest or in the exercise of official authority vested in us;

7.16. The right to lodge a complaint with a supervisory authority

If you believe that the way in which we process your data infringes data protection law, you have a legal right to lodge a complaint with a supervisory authority responsible for data protection. You can do this in the EU Member State of your habitual residence, your place of work or the location where the alleged breach took place. 8. International data transfer

8.1. We will ensure that a transfer of data to countries outside the European Economic Area is carried out with appropriate security measures. As we use Google Services, your personal data may be transferred outside the European Economic Area.

8.2. At the time of publication of this privacy policy, Google is in possession of a Privacy Shield certification. Should the Privacy Shield be declared invalid for any reason or should Google no longer comply with its obligations, we will ensure that other security measures, such as the standard contractual clauses provided by the European Commission, are used to protect your personal data.

8.3. You hereby authorise us to transfer your personal data outside the European Economic Area.

9. The disclosure of your personal data to others

9.1. In order to provide you with our services and to maintain a database containing your contact details, we work with a third party service provider to process and store your personal data. We work with the following service providers:

9.2. If you are a customer of ours, we may disclose your personal data to the suppliers we have contracted or intend to contract in order to provide our services to you. If you are a supplier to us, we may disclose your personal information to our customers to introduce you as a potential supplier, or in the course of providing the services.

9.3. We may also disclose your personal data in the event that this is necessary to comply with a legal obligation. We may also disclose personal information to protect your vital interests or the vital interests of another natural person.

9.4. As such, we do not disclose personal data to our social media partners. However, we do use social media plug-ins to direct you to our social media channels and give you the opportunity to use our content. These social media channels are Facebook, Instagram, LinkedIn, Twitter, Google+, Vimeo, Youtube and Pinterest. When you share an item via Twitter, LinkedIn or Google+, like an item using ‘Like’ on Facebook, watch a video embedded in our website via Vimeo, or click on a link to our profile on a social media channel, such a social media service provider may collect personal information about you and link that information to your existing profile on such channel. In such event, the social media service provider will act as an administrator.

Which cookies can others place when visiting Moxy?
